1. INTRODUCTION
Welcome to Thailandproperty.com. These Terms and Conditions (“Terms”) govern your access to and use of our real estate property listings and classifieds website operated in the Kingdom of Thailand. By accessing or using the Platform, you agree to be bound by these Terms in full. If you do not agree, please discontinue use immediately 555.
2. DEFINITIONS
- “User” means any individual or entity accessing the Platform, including visitors, registered members, and listers.
- “Lister” means any User who submits a property listing on the Platform.
- “Listing” means any property advertisement, post, or classified ad published on the Platform.
- “Property” means any land, building, condominium unit, or real estate asset advertised on the Platform.
- “Content” means all text, images, photographs, videos, descriptions, and other materials submitted to or displayed on the Platform.
3. ELIGIBILITY
3.1 You must be at least 20 years of age (the legal age of majority in Thailand) to use the Platform.
3.2 By using the Platform, you represent and warrant that you have the legal capacity to enter into a binding agreement under Thai law.
3.3 Foreign nationals using the Platform acknowledge that property ownership rights in Thailand are subject to restrictions under the Land Code Act B.E. 2497 (1954) and related legislation. It is your sole responsibility to seek independent legal advice regarding your eligibility to own or lease property in Thailand.
4. ACCOUNT REGISTRATION
4.1 Certain features of the Platform require you to create an account. You agree to provide accurate, current, and complete information during registration.
4.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.3 You agree to notify us immediately of any unauthorized use of your account.
4.4 We reserve the right to suspend or terminate accounts that contain false, misleading, or incomplete information.
5. PROPERTY LISTINGS
5.1 Accuracy of Listings. Listers are solely responsible for the accuracy, completeness, and legality of all Listing content. We do not verify the accuracy of any Listing and make no representations regarding the properties advertised.
5.2 Listing Requirements. All Listings must:
- Relate to a genuine property available for sale, rent, or lease;
- Contain accurate descriptions, pricing, and location information;
- Include only images that the Lister has the right to use;
- Comply with all applicable Thai laws and regulations.
5.3 Prohibited Listings. Listers must not post Listings that:
- Involve properties with disputed ownership or unresolved legal encumbrances;
- Misrepresent property type, size, price, location, or condition;
- Constitute fraudulent, deceptive, or misleading advertisements;
- Violate any third party’s intellectual property or privacy rights;
- Advertise properties in violation of Thai land ownership restrictions applicable to foreign nationals.
5.4 Listing Duration. Listings remain active for the period specified at time of posting. We reserve the right to remove any Listing at any time without prior notice if it violates these Terms.
5.5 No Endorsement. Publication of a Listing on the Platform does not constitute an endorsement, recommendation, or verification of the Lister, the property, or the terms of any transaction.
6. PLATFORM ROLE AND LIMITATIONS
6.1 The Platform is a classifieds advertising service only. We are not a real estate agent, broker, developer, or party to any transaction between Users.
6.2 We do not facilitate, mediate, or guarantee any transaction, negotiation, or agreement between Users.
6.3 Any transaction you enter into as a result of a Listing on the Platform is solely between you and the other party. We strongly recommend engaging a licensed Thai real estate agent and a qualified lawyer before entering into any property transaction.
7. USER CONDUCT
You agree not to:
7.1 Use the Platform for any unlawful purpose or in violation of these Terms;
7.2 Post spam, duplicate, or irrelevant Listings;
7.3 Scrape, harvest, or copy data from the Platform without our express written permission;
7.4 Interfere with or disrupt the security, integrity, or performance of the Platform;
7.5 Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
7.6 Use the Platform to solicit, collect, or store personal data of other Users without their consent.
8. INTELLECTUAL PROPERTY
8.1 All Platform content, including but not limited to design, logos, software, and editorial content created by us, is our exclusive property and is protected under Thai copyright law (Copyright Act B.E. 2537) and applicable international treaties.
8.2 By submitting a Listing or any Content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute such Content on the Platform for the purpose of operating the service.
8.3 You represent and warrant that you own or have the necessary rights to all Content you submit, and that such Content does not infringe any third party’s rights.
9. PERSONAL DATA AND PRIVACY
9.1 We collect and process personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.
9.2 By using the Platform, you consent to the collection, use, and disclosure of your personal data as described in our Privacy Policy, in compliance with the Personal Data Protection Act B.E. 2562 (PDPA).
9.3 You acknowledge that when you contact a Lister or share your contact details through the Platform, your information may be received and retained by that Lister.
10. FEES AND PAYMENTS
10.1 Basic listing services may be offered free of charge. Premium or featured listing services may be subject to fees as published on the Platform from time to time.
10.2 All fees are quoted in Thai Baht (THB) and are inclusive of applicable VAT at the prevailing rate under Thai law.
10.3 Fees paid are non-refundable unless otherwise stated or required by law.
10.4 We reserve the right to amend our fee structure at any time. Continued use of paid services following notice of a fee change constitutes acceptance of the revised fees.
11. DISCLAIMERS
11.1 The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by Thai law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
11.3 We make no representations regarding the suitability, legality, or accuracy of any Listing or the conduct of any Lister or User.
12. LIMITATION OF LIABILITY
12.1 To the fullest extent permitted by applicable Thai law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform.
12.2 Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount of fees, if any, paid by you to us in the three (3) months preceding the claim.
12.3 Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot be excluded under Thai law.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Platform, its owners, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your Listings, your Content, or your violation of these Terms.
14. THIRD-PARTY LINKS AND SERVICES
The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Access to third-party sites is at your own risk.
15. MODIFICATIONS TO THE PLATFORM AND TERMS
15.1 We reserve the right to modify, suspend, or discontinue the Platform or any part thereof at any time without notice.
15.2 We may update these Terms from time to time. The updated Terms will be posted on the Platform with a revised “Last Updated” date. Your continued use of the Platform after any update constitutes your acceptance of the revised Terms.
16. GOVERNING LAW AND DISPUTE RESOLUTION
16.1 These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand.
16.2 Any dispute arising out of or in connection with these Terms or your use of the Platform shall first be subject to good-faith negotiation between the parties.
16.3 If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the competent courts of Thailand.
17. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable under Thai law, the remaining provisions shall continue in full force and effect.
18. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding your use of the Platform and supersede all prior agreements or understandings.
